OPERATIVE PROVISIONS

  1. licence
    1. Munshi Living LLC is the accommodation owner’s agent and is authorized to allot the Accommodation to the Guests. In the context of owner’s Accommodation occupation, these terms and conditions are applicable to both you and Munshi Living LLC (owner’s agent).
    2. As stated in the Booking Summary, you hold the Accommodation occupation license for the agreed time period (“License Period”). The Accommodation occupancy and usage is either for a short term or for vacations.
  2. booking and cancellation
    1. In order to confirm your accommodation as booked, you are required to pay 50% of the full booking tariff as an “Initial Deposit”; the remaining 50% payment referred as the “Balance” should be paid at least a month before your stipulated date of arrival. In case of non-payment within 14 days’ booking arrival date, we hold the right to revoke the booking right away with zero refund.
    2. In case the booking is made within a month’s timeline of your stipulated date of arrival, then full amount must be paid right at the time of booking.
    3. Also, an on card pre authorization of a Refundable Security Bond is a prerequisite before you arrival date. This mandatory requirement aims at covering any incidental damages/ costs experienced during your stay. Upon satisfactory final inspection of the Accommodation post your stay, an automatic refund of this Security Bond will be made within 14 days’ timeline (from the date of departure) either by us, Accommodation owner or any of their authorized representative.
    4. Upon receiving either of the Initial Deposit or full payment, you will instantly receive your Booking confirmation email. Subjected to the Booking terms, the payment confirmation email is mandatory to bind us in a contractual obligation.
    5. You are advised to thoroughly check the Booking details before processing the payment alongside the confirmation email and instantly report any error/omission.
    6. Before your arrival, Guest Agreement must be completed in all respects. This is inclusive of your Photo ID verification to counter check your identity at the time of actual check-in. Stay assured about the safe custody of your Personal Information against any misuse/ loss/ theft/ unauthorized access/ disclosure and/or changes.   3. Payment Terms
    1. Having paid your Initial Deposit, make sure to send us the Balance payment as well as Security Bond at least a month before your actual date of arrival. In case of your failure to making the due full payment on time, your Booking may get cancelled.
    2. In case of Balance amount’s non-payment, Munshi Living LLC is authorized to auto deduct the said amount from the credit / debit card you have provided.
    3. The Security Bond may get charged as a penalty against any probable repair and maintenance of the Accommodation, furnishings, fixtures and fittings, necessary post stay cleaning, overstaying and/or house rules (already being notified) breaching. Post your departure, your Security Bond will be refunded after making necessary deductions (if any) as per listed terms and conditions.
  4. Booking – Long Term Lease
    1. Your initial booking duration exceeds to more than 02 months (60 days) timeline or
    2. With an existing booking, if you put forward an extension request that results in exceeding your total actual booking period above the Extended Term, then the actual agreement binds Munshi Living LLC and you into other agreements as deemed necessary by law.
    3. In the context of your Extended Term stay, we cannot confirm whether your booking is accepted or not unless likewise and/or other agreements are made by you through a licensed real estate agent.
    4. You fully understand and agree to the fact that our commitment towards Extended Term stays is different. As a real estate agent, you agree to adhere to all Munshi Living LLC’s directions and legal requirements – failing to which may lead to the cancellation of your Extended Term stay request.
  5. Cancellation and Amendments – in case you cause any
    1. If you want to cancel/ amend any Booking, please bring it to our notice at the earliest. No cancellation/ amendment will be made till the same is conveyed to us in writing / through email and acceptance of the same is confirmed by our end.
    2. In case you opt cancellation against your booking, no amount paid by yourself or on your behalf will be refunded. In case of cancellation within a month’s timeline where you haven’t already paid the Balance, the same will be your responsibility to pay off and we will be authorized to charge your credit card against this deduction.
    3. We will strive our best to re-let the Accommodation post your cancellation. Having achieved the Accommodation re-let against the complete/ any part of the dates corresponding to your original booking, we will offer you a non-cash credit equivalent to the total accommodation fees received (if any) for nights booked in the dates similar to your original booking (20% + GST to be deducted as a booking fee). This non-cash credit amount is valid to book any Munshi Living LLC’s accommodation within one year’s timeline post your original booking’s date of cancellation.
    4. In case you modify your booking by furnishing a three months’ notice, we will try to guiding you with regards to changes in the dates of your accommodation (based upon the availability, any difference in the accommodation rates may be additionally charged). In case of a booking modification with less than three months’ notice, no booking amount paid either by yourself and/or on your behalf will be refundable unless the Accommodation gets rebooked at the same rate as that of your original dates.
  6. Cancellations and Amendments – in case we cause the same
    1. The owners will strive at best to make sure the Accommodation remains available as per booking. However, the owners hold the right to change any bookings based upon unexpected circumstances, if any (flood, fire etc.). We would not deliberately alter your bookings, but there may be unforeseen situations leading to any booking modifications and/or quite rarely cancellations.
    2. If the same takes places, we will reach out to you at our earliest practical possibility and update you with booking alteration/ cancellation (whichever applicable). Against the Booking cancellation, we will make sure the fees refund. However, we will not be responsible to refund any of the fees you have paid to a third party against your holiday (without limitation to include travel fees, entertainment/ activities expenses and/or insurance).
  7. BOOKING AND CANCELLATION – extended term stay
    1. Your initial booking duration exceeds to more than 02 months i.e., 60 days (Extended Term) timeline or
    2. With an existing booking, if you put forward an extension request that results in exceeding your total actual booking period above the Extended Term, then the actual agreement binds Munshi Living LLC and you into other agreements as deemed necessary by law.
    3. In the context of your Extended Term stay, we cannot confirm whether your booking is accepted or not unless likewise and/or other agreements are made by you, us and through a third party. Before any such agreements, any amount that we have received constitute trust and is refundable to you in case the booking halts.
    4. You fully understand and agree to the fact that our commitment towards Extended Term stays is different. You agree to adhere to all directions and legal bindings – failing to which may lead to the cancellation of your Extended Term stay request.
  8. FEES AND CHARGES
    1. As per the Booking Summary, you agree to pay off the Accommodation Fees without deduction. You also commit to pay against any Accommodation damage (if any) as well as to bear the fees caused by your overstaying or violating House Rules.
    2. The Accommodation Fees as mentioned under the Confirmation of Booking are meant for the Accommodation only. In case of opting any additional services while booking from Munshi Living LLC, you will be separately charged through your designated credit card.
    3. Acceptance to these terms constitutes your agreement to pay full Accommodation Fees alongside authorizing Munshi Living LLC and/ or third party designated by Munshi Living LLC to collect the full payment instantly as set out in the Booking Summary. Failing to avail your booking or check-in, you will be liable to pay off the entire Accommodation Fees against the booking (and you hereby permit Munshi Living LLC, or any of its third party), to charge the provided debit/credit card against the said amount.
    4. All the transactions are made in USD.
    5. Munshi Living LLC and/or any of its nominated third party will collect all fees and charges inclusive of GST. There will be a trust account to hold entire deposit and bond fees.
  9. SECURITY BOND

Munshi Living LLC and/ or its designated third party will pre-authorize a specific amount from your credit card as Security Bond before you actually begin your Accommodation stay. Munshi Living LLC and its authorized third party agent will reserve the right to make any necessary deductions from this pre-authorized amount either to compensate against any damages to the Accommodation/ its contents or to fix overstaying/ house rules violation issues. Furthermore, this clause does not restrict our rights to recover against any damages caused to the Accommodation over and above the Security Bond.    

 

  1. CHECK OUT

For the Accommodation check-out time, please refer to the Booking Summary. If you haven’t agreed to an early check-in or a late check-out or an extended period of occupation in advance, then any overstaying will cost you a full day’s Accommodation fee. In case of your overstay by more than 2 hours, we hold the right to enter the Accommodation,  do away with your belongings, change the Accommodation locks and may take further necessary actions (and will charge you for any costs incurred against these actions). Also, you will be responsible for the daily Accommodation Fee along with an additional $1,000.00 per day (or part of it) against any unauthorized overstay.   

  1. SAFETY AND CONDUCT
    1. During your stay at the Accommodation, your own safety is the first and foremost responsibility. From the Guest Information Book available at the Accommodation, you should keep yourself aware of the House Rules, any instructions as well as fire/ health and safety guidelines and you should also pay heed to the Munshi Living LLC staff’s instructions/ explanations while they are touring you around the Accommodation.
    2. In case you figure out any health and safety risk anytime during your stay, don’t hesitate to immediately bring it to the notice of Munshi Living LLC.
    3. You should strictly adhere to the House Rules while at the same time ensuring compliance with any building rules and Munshi Living LLC’s practical guidelines.
    4. Acknowledge the fact that to ensure complete protection of the Accommodation and its residents, some properties rely on external video surveillance systems. During your Accommodation stay, you agree to external video surveillance system usage.
    5. Unless otherwise mentioned in the Booking Summary along with the additional yet registered guests, you may not permit any unnamed individual to occupy the Accommodation at any time during your stay. This is an in-person agreement nontransferable to any other person. Munshi Living LLC will not permit any individual other than the ones specified in the Booking Summary to access/ occupy the Accommodation. During any of your invitee’s temporary stay at the Property, you will be the one fully responsible for his/her overall conduct.
    6. The Booking Summary may clearly state the maximum allowed guest count to occupy / stay at the Accommodation. In case of non-compliance of the same, you will be responsible for the supplementary payment exceeding up to $500.00 per night against each unauthorized guest; the same may also lead to an immediate rental termination.
    7. Not only you will ensure compliance to the Membership Rules, House Rules and other reasonable guidelines but also make sure to:
    8. keep the Accommodation spick and span in all respects and leave it the same clean and tidy as first received;
    9. not to take along any pets/ animals in the Accommodation without a prior written agreement
    10. not to do/ exercise anything that may time and again lead towards Accommodation contractual breach or Accommodation insurance agreement breach (whole / partial)
    11. not to leave / impede any objects or waste in a common property in case the Accommodation is located in a building / complex
    12. not to create/allow any blockade outside the Accommodation
    13. not to allow/ engage in any activity within and outside the Accommodation that may become a source of annoyance and inconvenience as well as damage and disturbance to the Munshi Living LLC, its tenants, building occupants, owner/ occupier of the neighboring buildings by playing loud music, listening to loud music, dancing, indoor entertainment or dragging heavy furniture
    14. not to carry out any illegal/immoral activities in the Accommodation.
    15. not to undertake any business/commercial activities from the Accommodation such as carrying out photoshoots unless explicitly authorized in writing by Munshi Living LLC
    16. no to carry out any single addition/modification to either of the Accommodation or its contents
    17. not to use the Accommodation against any person other than the personal accommodation
    18. not to intrude Munshi Living LLC’s privacy or that of the owner as well as neither publish nor disclose anything to avoid any third party identify the Accommodation’s address or Munshi Living LLC’s identity (regardless that information is already made public)
    19. not to arrange a party/ get-together and/or invite 6+ people prior to seeking Munshi Living LLC’s consent. In case such an event sounds too noisy and/or causes any kind of inconvenience either to the neighboring Accommodations or appears disrespectful to the Munshi Living LLC, then Munshi Living LLC has the sole discretion to expel you from the Accommodation alongside imposing a hefty charge of $ 5,000.00 (over and above the sums due as part of this Agreement).
    20. During your stay, if you are found guilty of any House Rule violations displayed at the Accommodation, then the agreement binds you to pay $5,000.00 additionally and may also expel you without prior notice while providing zero refund/credit against any unused nights.
    21. You hereby agree to treat the Accommodation as a home and accept not to exercise any unauthorized access to any of the drawers/cupboards sealed with tamper tape/ locking device and you consent to pay $500.00 as a fixed fine against any violation attempts (tampering tape/ unlocking device).
    22. You acknowledge to compensate Munshi Living LLC and the Owner against any costs, claims/liabilities incurred or expenses caused to Munshi Living LLC (or their agents) as a result of this Agreement’s violation.
  2. Munshi Living LLC NOISE RESTRICTION
    1. We follow a strict “No Party / No Additional Guests” policies for all our houses. Since sound easily makes it way to the neighborhood therefore noise levels must remain a respectable consideration all day long with zero tolerance to music / outdoor entertainment right after 10 pm.
    2. In case a noise complaint is received, it may lead to serious consequences including security bond deduction, house inspection through the security guards to investigate the noise levels disrupting neighborhood’s peace. The fine of $500 per compliant with security inspections can take place during 6 pm to 6 am slots. In case of multiple noise complaints, you may be asked to leave the Accommodation on immediate note with zero tariff/ security bond refund.
    3. Noise levels are a major concern for Munshi Living LLC as our neighbors’ peace and happiness is our utmost priority.
    4. If you are found guilty of breaching any House Rule clearly displayed at the Accommodation, you are liable to pay $5000.00 as an additional fee and this may result in immediate expulsion without any prior notice as well as zero refund/ return against any unused nights.
    5. You are convinced that the Accommodation is just like your home and consent not to exercise any unauthorized access to the pre-sealed (tamper tape/ locking device) drawers and cupboards as well as you agree to recover against any breach by paying $500.00.
    6. You agree to indemnify Munshi Living LLC and the Owner against any costs/ liabilities/ expenses incurred at the part of Munshi Living LLC (or their agents) that may result in breaching this Agreement.
  3. PROPERTY DAMAGE
    1. In case any damage to the Accommodation, its belongings, fittings and fixtures etc., is experienced during your stay and you find it a usual wear and tear with none of your fault, even then immediately bring it to the notice of Munshi Living LLC. We will then inspect and finalize whether or not the damage comes under fair wear and tear.
    2. Failure to bring any such damage to the notice of Munshi Living LLC will make you fully responsible to compensate it on a full replacement basis.
    3. Alongside full repair amount, you will be liable to pay $50 per hour for a Munshi Living LLC’s contractor who will be managing the trade aspects arising out of repair damage incurred.
    4. Any damage caused to the property will be directly charged to your credit/debit card details available with us and/or against the security deposit you have already pre-authorized with us. However, to eliminate any confusion and/or to avoid any further doubts, note that in case of any damage, you will be required to indemnify against the total loss caused and not only for the amount you have pre-authorized under Security Bond.
    5. Failure to return the Accommodation keys at the time of check-out will cost you for the complete change of barrels as well as the new key set charges.
  4. INSPECTION

Munshi Living LLC holds the right to enter in the Accommodation as part of the Premises’ repair and maintenance assessment and inspection. You will, however, be notified 7 days in advance about any such inspection. In case an emergency/urgent need to repair and maintenance arises, we are authorized to enter in and inspect the accommodation any time.

  1. LIABILIY AND CLAIMS To the extent permitted by law:
    1. Munshi Living LLC will not be responsible for any of your monetary losses (business/ financial/ economic) as well as indirect losses (lost goodwill/ bargain/ lost profit/ declined savings/ missed opportunities etc.,) that may take place from this agreement, the Accommodation/ rental losses (regardless this loss is caused by Munshi Living LLC’s ignorance or otherwise).
    2. Munshi Living LLC’s responsibility against all the losses (except personal injury/ death resulting out of ignorance) will be restricted to the cost of acquiring replacement accommodation against the agreed License period or the Accommodation Fee amount and/or charges still payable at your part (whichever amount is higher).
    3. Nothing in this clause restricts / excludes Munshi Living LLC or the owner’s responsibility in case of death/ personal injury resulting out of ignorance (either their or their agents/ employees)
  2. GENERAL
    1. You acknowledge that you are authorized to enter into this License.
    2. You will not be eligible to hold back any amounts under set-off, deductions, counterclaims whichever you owe to Munshi Living LLC and vice versa.
    3. This agreement allows Munshi Living LLC to either sub-contract or delegate their responsibilities.
    4. In case of any delay/ inconvenience/ failure to perform necessary obligations at the part of Munshi Living LLC that is caused out of unavoidable circumstances beyond Munshi Living LLC’s reasonable control, then it will neither be responsible towards you nor accused for any breach of terms.
    5. The agreement terms and the Booking Summary reflect the overall agreement between the concerned stakeholders and supersede any prior shared marketing insights, representations or contracts whether or not documented in written.
    6. The parties to the agreement consent to the terms as reasonably fair in all respects. However, in case any of its provisions is invalidated by a Court of competent jurisdiction yet validated upon deleting particular wording, then the provision applicability will come into effect upon such deletions as deemed necessary to establish its validity. In case any provisions within these terms are invalidated the remaining provisions will continue to prevail in full force and effect.
    7. Under US and its particular state (where the Accommodation is located) laws, these conditions are governed and interpreted. You hereby acknowledge to submit to the particular state’s exclusive jurisdiction.
    8. In case you are found guilty of violating any of these terms and conditions and Munshi Living LLC chooses not to take necessary action or ignores such an act, even then Munshi Living LLC has the right to exercise any action, impose its rights and claim compensation against any breaches.

    10. PET CLAUSE
      1. In case the house you seek the Accommodation in is marketed as “pets considered” then you are required to submit an application for the pets’ approval with their age and breed clearly mentioned. It will then Munshi Living LLC/ owner’s sole discretion to approve or decline the application.
      2. At the Accommodation, you are allowed to keep only 2 dogs at a time. The pet fee is $225 per animal.
      3. The safety of your dogs is your sole responsibility. Stay aware that there are snakes and ticks in the surroundings.
      4. Wandering to the neighboring properties whether fenced or not is strictly prohibited.
      5. You consent to a flea treatment to your pets prior to arrival at the Accommodation.
      6. For dogs, you are advised to bring along the dog bed; they are strictly not allowed to use Accommodation furniture. Any costs incurred against any additional cleaning of the pets’ fur, smell or stains will be directly charged to you.
      7. Before leaving, you are responsible to clean the garden for any kind of pets’ mess. In case Munshi Living LLC’s staff will clean any kind of mess, the costs involved will be deducted from your Security Bond.
      8. Only if you are sure that the dogs will not bark, then you can leave them alone at the backyard. Any noise complaints from the neighborhood arising out of barking dogs will be charged to your Security Bond or you will be asked to leave the Accommodation.
      9. Hosing down the areas where the dogs have urinated remains your sole responsibility.
      10. You are strictly warned not to bring any dog that sounds vicious, extremely barks and falls under the ‘Dangerous Dogs’ category as per Companion Animals Act 1998.
